Setting Aside Your Criminal or Arrest Record:
A motion to set aside (called expunction or expungement) is a legal proceeding to seal your record of a criminal arrest and/or conviction. After a motion is granted, all official records of the arrest and conviction are sealed. In the eyes of the law, the arrest or conviction did not occur and the record no longer exists. In order to expunge an arrest, conviction, or dismissed charge, your lawyer must file a “Motion to Set Aside” with the court in the Oregon county where the incident occurred. The court then must grant the motion for an expungement to take place.
